It is deceptive to claim ownership of a non existent patent. (Patents Act 1990).  It is illegal to do this around the world.

The Australian Governments patent body IP Australia writes repeatedly that the Jean Madden Street Swag is NOT patented. Read the letters. Click here

For many years Jean Madden has continued to ignore IP Australia's official letters, and instead promotes her false patent claim on the official Jean Madden Street Swag charity website and more.

Question: Can patent misrepresentation help a "charity" to fundraise from the public?

Answer: A patent would reflect a unique invention while creating credibility for the founder and  "charity".  Patent misrepresentation may help win awards.  Patent misrepresentation may create media opportunities.  Patent misrepresentation may create comfort for trusting donors, corporates and community groups.

Disappointingly, there are several awards which highlight the Jean Madden false patent claim; Telstra Business Women's Awards and Shining World Compassion Award October 2007. How many other awards include false patent misrepresentation on their nominations? Can awards judges be influenced when they read on the official Street Swag website, and again in the media about Jean Madden's claims of holding a patent? Is it an unfair win - when something that the Government says does not exist, is instead taken for truth?
